U.S. Customs and Border Protection (CBP) will launch a new tariff refund system within approximately 45 days, allowing importers to claim refunds for recently invalidated tariffs.

The proposed process will require minimal submissions from importers, streamline duty validation and recalculation in the system, and enable the Department of the Treasury to issue consolidated refunds with interest.

  • Court ruling on IEEPA duties: The U.S. Court of International Trade has directed U.S. Customs and Border Protection (CBP) to remove IEEPA tariff duties from certain entries and process refunds where applicable.
  • Unliquidated entries: Entries that have not yet liquidated are expected to be finalized without IEEPA duties applied.
  • Potential refunds: Entries that recently liquidated may be eligible for reliquidation and duty refunds, with statutory interest applied once validated by CBP.
  • CBP review process: CBP will conduct its standard verification before issuing refunds to confirm compliance with other programs such as anti-dumping duties, Section 301, and Section 232 requirements.
  • Upcoming Section 122 increase: Treasury Secretary Bessent announced that the Section 122 tariff rate may increase to 15% by the end of the week, with the temporary measure scheduled to expire on July 24.
