Tariff and Trade Update:
Trade policy, customs requirements and transportation conditions continue to evolve. Below is a summary of recent developments and practical information to help you prepare for changes impacting supply chains.
  • IEEPA Tariff Refund Litigation Advances: The U.S. Court of International Trade (CIT) certified a class action seeking refunds of duties paid under challenged IEEPA tariffs. Refunds have not been ordered, and importers with separate lawsuits are excluded from the class. A proposed schedule outlining next steps is due October 22.
  • Section 122 Tariffs Remain Under Appeal: The CIT ruled that the 10% global tariffs imposed under Section 122 exceeded presidential authority and ordered refunds for the named plaintiffs only. The government appealed, and the case remains pending, leaving broader relief uncertain.
  • CBP Proposes New Rules for Low-Value Shipments:  A proposed rule published earlier this month would require electronic filing and a bond for informal entries valued at $2,500 or less, create a new electronic entry type for postal shipments, and add sender and tracking information requirements. Comments are due December 7.
  • USTR Seeks Input for 2027 USMCA Review: The Office of the United States Trade Representative (USTR) is inviting public comments ahead of the 2027 review of the United States-Mexico-Canada Agreement (USMCA). Businesses can share how the agreement affects their cross-border operations, with comments due January 12, 2027.
  • Polysilicon Import Monitoring: Before the Section 232 polysilicon duties and minimum import prices take effect December 4, Commerce is monitoring imports of polysilicon, wafers, and solar cells and modules for volumes well above historical levels.
  • Mexico Removes Import Permit for Textiles and Apparel: Mexico no longer requires an automatic import permit for textile and apparel imports. All other permits and non-tariff requirements, including labeling standards, remain unchanged.

Recent trade data shows continued growth in U.S.-Mexico commerce, reinforcing Mexico’s importance in North American supply chains.

We offer cross-border logistics services to help businesses coordinate transportation and customs processes.

U.S. rail intermodal traffic increased 10.4% year over year earlier this month, reflecting continued activity in freight transportation.

For businesses moving goods across the country, rail intermodal can provide an alternative to long-haul trucking and greater flexibility when planning transportation.

U.S. warehouse demand strengthened in the third quarter, with more industrial space being occupied and vacancy rates declining.

This highlights the importance of warehouse capacity and inventory planning as businesses adapt their distribution strategies.

Parallel Systems raised $100 million to expand its battery-electric autonomous rail technology, designed for shorter freight routes.

The technology could give shippers more options for moving domestic freight.

Since earlier this month, changing ACH refund information in ACE requires an email or text verification.

Importers expecting tariff refunds should review their account information and ensure their contact details are current.
